By: M.S.Yatnatti: Editor and Video Journalist Bengaluru:Applications Are Invited For 5000 Sites by BDA in Kempegowda Layout while it has failed to give possession of sites to many Arkavathi Layout allottes who have paid complete site value and waiting for possession of sites since several years .If the same mistake was committed by any private builder he would have been behind bars by now .But BDA officers are committing blunder .Let BDA give possession sites to Arakavathi Layout allottes and then think of taking money for other new layout. BDA may face PIL in this aspect very soon.Many alottees were thrilled in 2004 whenthey were allotted a sites in Arkavathy Layout. Two years later,alottyee's joy was cut short when the Bangalore Development Authority (BDA) took backtheir sites after land earmarked for the layout was denotified by the state government.
While the site allottees have decided to take legal action against the BDA, officials are finding it hard to take complete possession of the land notified for the formation of the layout. Following the row over denotification of 983 acres in the Arkavathy Layout by successive governments, the allottees now fear whether they will actually get the sites. The BDA has no land available anywhere to give allottees 8,000-odd alternative sites. Some of the allottees threatened to initiate contempt of court proceedings against the BDA.Reportedly perhaps, fed up with the perfunctory attitude of Bangalore Development Authority (BDA) authorities in completing the formalities to acquire land for formation of Arkavathy Layout sites, the allottees, who have been fighting for their legitimate rights since 2006, have decided to approach the high court for justice.According to reliable sources, dozens of allottees may file writ of mandamus in the HC. Writ of mandamus is an extraordinary writ commanding an official to perform a ministerial act that the law recognises as an absolute duty.
