RESTORE THE POSSESSIONS OF GENIUS ENTERPRISES AND TERMINATE VISHAL INTERNATIONAL ASSOCIATION ILLEGAL BOT CONTRACT

By: M.S.Yatnatti: Editor and Video Journalist Bengaluru: Demand is made to restore the contract of Genius Enterprises got through tender and work orders issued and agreements signed for 13 toilets by giving possession to them by terminating the contract given to Vishal International Association illegally without calling tenders and without calling tenders for BOT contracts and without following THE KARNATAKA TRANSPARENCY IN PUBLIC PROCUREMENTS ACT, 1999 KTPP Act 1999. It is reported and alleged that Joint commissioner BBMP Malleshwaram zone and EE (BBMP Gandhi Nagar) has given more than 150 existing toilets maintenance contracts to Vishal International Association illegally without following on BOT - Build Operate and transfer basis on 15 years contracts without calling tenders for BOT contracts and snatching the contracts and work orders already given as per tendersto ex BBMP employees and their children's. It is reported that that this irregularity is committed under the influence of unlimited corruption.

Request is made to set aside the order of Executive engineer (BBMP Gandhi Nagar) terminating the Toilet contractsdated 30-03-2015in respect of Genius Enterprisesgot through tender and work orders issued and agreements signed 13 toilets .But possession was not given till today by EE (BBMP Gandhi Nagar)despite requests made by Genius Enterprisesand now suddenly without any valid reasons contracts were terminated without giving possession and contracts and possessions of 13 toilets weregiven to Vishal International Associationillegally (without following THE KARNATAKA TRANSPARENCY IN PUBLIC PROCUREMENTS ACT, 1999 KTPP Act 1999 )on BOT - Build Operate and transfer basis on 15 years contracts without calling tenders for BOT contractsand snatching the contracts and work orders alreadygiven as per tendersto ex BBMP employees and their children's. and We request you to order for CID or Lokayukta Investigation on Joint commissioner BBMP Malleshwaram zone and EE(BBMP Gandhi Nagar) WHO has given more than 150 existing toilets maintenance contracts to Vishal International Associationillegally on BOT - Build Operate and transfer basis on 15 years contracts without calling tenders for BOT contracts . It is reported that that this irregularity is committed under the influence of unlimited corruption.

I have asked to provide me information and reasons under section 4(I) (a) (b) (c) (d) RTI Actaction taken report as per our letter and delay in respect of cancellation of illegal contracts given to Vishal International Associationillegally (without following THE KARNATAKA TRANSPARENCY IN PUBLIC PROCUREMENTS ACT, 1999 KTPP Act 1999 )on BOT - Build Operate and transfer basis on 15 years contracts without calling tenders for BOT contractsand snatching the contracts and work orders alreadygiven as per tendersto ex BBMP employees and their children's and also provide me and also provide me informationand reasons under section 4(I) (a) (b) (c) (d) RTI Act action taken report as per our letter and delay in giving possessions of 13 toilets contracts dated 30-03-2015in respect of Genius Enterprisesgot through tenderand work orders issued and agreements signed in respect of 13 toilets and after giving possessions and then take the EMD from Genius Enterprises.The BBMP is THE PUBLIC AUTHORITY under obligation to provide information "PUBLICLY” under section 4(I) (a) (b) (c) (d) RTI Act. .This information and reasons need to be provided to me as per Guide on RTIto Information Act 2005 published by the Government of India Ministry of Personnel, Public Grievances & Pensions Department of Personnel & Training (available here :http://rti.gov.in/RTICorner/Guideonrti.pdf) on page 12 and Para 9, following is stated: Providing Reasons for Decisions: The public authorities take various administrative and quasi-judicial decisions which affect the interests of certain persons. It is mandatory for the concerned public authority to provide reasons for such decisions to the affected persons. It may be done by using appropriate mode of communication .Attention is also invited towards the thread 'affected person ' under rti act.In fact, it can be said that "Affected" refers back to an action. The"Affected Persons" are the ones who are affected by that action. The reasons need to be given to affected person and copy of that can be given to me under 2 f of RTI Act. The BWSSBoffice is THE PUBLIC AUTHORITY under obligation to provide information "PUBLICLY” under section 4(1) (a) (b) (c) (d).
