By : M.S.Yatnatti: Editor and Video Journalist Bengaluru : Even today SC and ST people facing discrimination even from Government authorities like BDA .Bangalore Mahanagar Palike S C Workers co-op society Ltd is facing unnecessary litigation for several years on silly reasons quoted by BDA officers who are against schedule caste people .Bangalore Mahanagar Palike S C Workers co-op society Ltd owns 12 495.5 sq feet in S No 14 Gerehalli Village Uttrhalli hoblli Srinivas Nagar Bengaluru through registered sale deeds from the owner Ramaswamy since 1973 and they are in possession since then . who are in settled possession asserting possession and ownership in themselves , openly, peacefully and uninterruptedly to the knowledge of BDA, for more than 30 years, in blatant violations ofseveral court orders and specially reported judgment inJohn B. James And Others vs Bangalore Development Authority ... on 7 August, 2000 which clearly held that "If anyone, who has trespassed into BDA land or in unauthorized possession of BDA land, has put up a structure and completes and accomplishes the act of possession and continues in such settled possession asserting possession and ownership in himself, openly, peacefully and uninterruptedly to the knowledge of BDA, for more than 12 years, then it is possible for him to contend that they haveperfected thier title to such property by adverse possession and consequently the title of BDA stood extinguished. It is needless to say that such adverse possession for 12 years should be subsequent to the date of vesting of land in BDA.”,.BDA Assistant commissioner need to revoke notices issued to Bangalore Mahanagar Palike S C Workers co-op society Ltd before they are quashed by courts.

Bangalore Mahanagar Palike S C Workers co-op society Ltd owns 12 495.5 sq feet in S No 14 Gerehalli Village Uttrhalli hoblli Srinivas Nagar Bengaluru through registered sale deeds from the owner Ramaswamy since 1973 and they are in possession since then In the same survey number 35 others had purchased sites from same owner Ramaswamy as ramasawamy was the grantee of the land.BDA after scrutinizing the title of Ramasawamy and 35 site owners as per section 38 C (1)(a) reconveyed the sites to 35 site holders except Bangalore Mahanagar Palike S C Workers co-op society Ltd which owns the land of 12 495.5 sq feet in the same S No 14 Gerehalli Village Uttrhalli hoblli through registered sale deeds from the sameowner Ramaswamy.This is clear case of discrimination and violation of human rights of schedule caste people and atrocity on schedule caste people by commissioner Sham Bhat and other officers .Bangalore Mahanagar Palike S C Workers co-op society Ltd has 3000 SC members belonging to BBMP. Chief minister should immediately intervene in the matter and issue orders for reconveyance of land and execution of sale deeds to Bangalore Mahanagar Palike S C Workers co-op society Ltd. State government have all the power under general clause Act and BDA Act and in humanitarian consideration andthe larger interest of schedule caste people. Non SC gets Reconveyance in same S No 14 Gerehalli Village Uttrhalli hoblli through registered sale deeds from the sameowner Ramaswamy and schedule caste people are booted out in BDA. It is reported that some BDA officers had gone there to demolishstructure yesterday which is existing since 1973 to demolish it belonging to schedule caste people.Request is made to Sri M.N.Reddy IPS, to provide police protection to Bangalore Mahanagar Palike S C Workers co-op society Ltd the schedule caste people. In the similar way chief minister need to issue orders in many cases .Corruption is reported to be unlimited in Re-convey and re-allotment section of BDA.BDA should immediately provide sale deeds to Muniswamys/o Abbaiah to extent of land permissibleas per law in survey number S.No 50 (S No50/1 and 50/2 ) of Dukanhalli (doopanhalli) Villlage Kasba Hobli HAL 2ndStage Bangalor which comes in Re-Convey area as per BDA resolution in Subject No. 378. As per proceedings of the Bangalore Development Authority's meeting dated 17-11-1982 . The resolution of CITB /BDA of 17-11-1982agreeing to re-convey the part of the land acquired is covered by the provisions of Section 9 of the Amendment Act. In the present case, the resolution of the CITB/BDA is dated 17-11-1982and it wouldbe deemed to be validated by the deemed fiction created by Section 9 of the Amendment Act to bring it within the provisions of Section 38 -C.
