THE BWSSB CHAIRMAN VIOLATED HIGH COURT ORDERS IN RESPECT OF METER READER

By: M.S.Yatnatti: Editor and Video Journalist Bangaluru: :By: M.S.Yatnatti: Editor and Video Journalist Bengaluru: The Commissioner for persons with disabilities in Karnataka State has been requested to issue notice to BWSSB which need to consider revoking the order issued on 13-06-2013 removing Smt Mahalakshmi RD/O Sri Ramaiah Handicapped Person from meter reader post or file contempt petition before high court against BWSSB. Smt Mahalakshmi RD/O Sri Ramaiah meter reader Handicapped Person was removed from the post in BWSSB in violation of Cadreand recruitment rules of Government of Karnataka andcommitted contempt of high court order inWP 20419 /2012 dated 31-08-2012. BWSSB need to consider revoking the order issued on 13-06-2013 removing Smt Mahalakshmi RD/O Sri Ramaiah. The Commissioner for persons with disabilities in Karnataka State has been requested further to issue a noticeto BWSSB to consider revoking the order issued on 13-06-2013 removing Smt Mahalakshmi RD/O Sri Ramaiahwho was appointed on 07-01-2013 as meter reader as per recruitment process in view of the order in WP 20419 /2012 dated 31-08-2012 appointing Shri N Basavarajuas meter reader and withoutdisturbing the list already published and according to which she was given and appointed to the post of meter reader on07-01-2013 and in view of several meter reader post are vacant and for which fresh appointments' are being made in BWSSB . And possibility exists in BWSSSB not to disturb the original list published as per order in WP 20419 /2012 dated 31-08-2012 and removing Smt Mahalakshmi RD/O Sri Ramaiahis nothing but contempt of court . Shri N Basavarajuappointment should have been done without affecting the appointment of Smt Mahalakshmi RD/O Sri Ramaiah which was done as per Cadreand recruitment rules of Government of Karnataka and once appointed cannot be removed and removal has to happen as per due process of law .Smt Mahalakshmi RD/O Sri Ramaiah was removed without following any law and without process of lawand injustice committed to her as list already published was not quashed by either by The Commissioner for persons with disabilities in Karnataka State or by Karnataka high court in any proceedings .

I have asked PIO of BWSSB office to provide me the information under section 4(1) (a) (b) (c) (d)whether chairman or CAO has power to overrule Karnataka high court order in WP 20419 /2012 dated 31-08-2012 and remove handicapped meter reader Smt Mahalakshmi RD/O Sri Ramaiah in BWSSB ?.This information and reasons need to be provided to me as per Guide on RTIto Information Act 2005 published by the Government of India Ministry of Personnel, Public Grievances & Pensions Department of Personnel & Training (available here :http://rti.gov.in/RTICorner/Guideonrti.pdf) on page 12 and Para 9, following is stated: Providing Reasons for Decisions: The public authorities take various administrative and quasi-judicial decisions which affect the interests of certain persons. It is mandatory for the concerned public authority to provide reasons for such decisions to the affected persons. It may be done by using appropriate mode of communication .Attention is also invited towards the thread 'affected person ' under rti act.In fact, it can be said that "Affected" refers back to an action. The"Affected Persons" are the ones who are affected by that action. The reasons need to be given to affected person and copy of that can be given to me under 2 f of RTI Act. The KSOU office is THE PUBLIC AUTHORITY under obligation to provide information "PUBLICLYā€¯ under section 4(1) (a) (b) (c) (d).
