ISSUE NARC TO SHRI AEKORAMASWAMY TO GET SWATANTRA SAINIK SAMMAN” PENSION “HONOUR THE SELF RESPECT OF “FREEDOM FIGHTERS”

Hence I request Karnataka Government Issue NARC in proper format as all dissect authorities have issued non availability of informationand recommend sanctioning of Swatantra Sainik Samman Scheme of the Centre Monthly Pension Scheme along with a Personal Knowledge Certificate (PKC) from a Sri Shivaswamy prominent freedom fighter who had proved jail suffering for a minimum of two years before Independence.ALL district authorities District magistrate District court and District Jial authorities have issued information that Sri B.M.Aekoramaswamy s/o Late shri Marulappa of Chickkamaglur District participated in quit India freedom movement and remained under ground and they do not have any records pertaining to issue of warrant for his arrest andcourt proceedings and court order pursuant to which he has suffered underground suffering so DPAR need to issue NARC IN required format .Under the Swatantra Sainik Samman Scheme of the Centre were required to submit primary evidence such as an order passed during the British regime detaining a freedom fighter in jail or proclaiming him as an absconder or announcing an award on his head or for his arrest. If such documents were not available, they could submit a Non Availability of Records Certificate (NARC) from the State or Union Territory concerned along with a Personal Knowledge Certificate (PKC) from a prominent freedom fighter who had proved jail suffering for a minimum of two years before Independence.NARC need to contain the following format :All concerned authorities of the State Government, who could have relevant records in respect of the claim of the applicant, have been consulted and it is confirmed that the official records of the relevant time are not available".

In order to understand what exactly the NARC would include and who has to issue such NARC, the following two circulars dated 07.06.1996 and 02.11.1998 are relevant. It is suggested that the official records available with the District authorities, Jail authorities, Police authorities, verified and on the recommendation of the entire NARC may be issued. Therefore, in order to avoid this situation, it has been decided with the approval of Minister that Certificate about Non-availability of Official Records should be issued by the State authorities and will have to be worded as follows : "All concerned authorities of the State Government, who could have relevant records in respect of the claim of the applicant, have been consulted and it is confirmed that the official records of the relevant time are not available". The State Governments etc. are therefore, requested that the above policy guidelines may be kept in view while issuing a Certificate about Non-availability of Official Records in respect of a claim made for grant of pension for consideration of the Central Government. They are advised to issue necessary instructions to all the District Authorities for compliance before issuing NARC to a freedom fighter. Accordingly DPAR issued letter to District authorities, Jail authorities, Police authorities, verified in respect of B.M.Aekoramaswamy S/O Late Shri Marulappa of Chickkamaglur District and NARC in official format need to be issued as records of relevant time are not available in respect of criminal case Number 122 under PS Act 47-48 in respect of B.M.Aekoramaswamy S/O Late Shri Marulappa of Chickkamaglur District for Swatantra Sainik Samman Scheme of the Central Government as records pertaining FIR summons trial of case order and when he was released as his Bangalore Jail certificates only mentions as Under Trial Imprisonment of 15 days and then transfer (No Mention of Release date as he was absconding after issue of summons ) afterAll concerned authorities of the State Government the District authorities, Jail authorities, Police authorities who could have relevant records in respect of the claim of the applicant, have been consulted as they got Copies of their letters .I have filed an RTI Application to MHA FFR Division Central Government to provide me information and reasons under section 4(I)(d) RTI Act for not sanctioningSwatantra Sainik Samman Scheme of the Centre B.M.Aekoramaswamy s/o Late shri Marulappa of Chickkamaglur District Karnataka despite he is eligible as he has provided secondary evidence a Non Availability of Records Certificate (NARC) from the State along with a Personal Knowledge Certificate (PKC) from a prominent freedom fighter who had proved jail suffering for a minimum of two years before Independence.and applied for pension with all required documentsfor Monthly Pension Despite he was recommended to central Government by state government with Non Availability of Records Certificate (NARC) by DC Chickkamaglur District and participated in quit India freedom movement and remained under ground for more than five years and went for jail many times but Hehave records of only one case. A case was filed in PSW 122/47-48 in early 1947 and Heunderwent underground and he was sentenced on 8-10-47 (after proceedings of more than 6 months by District magistrate Chickmaglur District under section 3 of the M.P.S Act and convicted and sentenced for 15 days jail as per Jail record .This case number is noted in his jail certificate. Hence he is eligible to get SSS pension since the date of his application.Brief fact of the case: Shri B.M .Aekoramaswamy s/o Late shri Marulappa of chickkamaglur District participated in quit India movement and remained under ground for about five years and went for jail many times but he has records of only one case . A case was filed in PSW 122/47-48 and he underwent underground and he was sentenced on 8-10-47 by District magistrate Chickmaglur District under section 3 of the M.P.S Act and convicted and sentenced for 15 days jail as per Jail record .As he do not have magistrate court proceeding record as proceedings might have gone for more than six months in a normal case from the date of filing he PSW 122/47-48 by police andsubmitted NARC from DC and PKC from shri Shivaswamy who has undergone jail for more than 2 Years and hence eligible for Swatantra Sainik Samman Scheme of the Centre .
