Request is made to take action on accused directors of Salarpuria Properties Private Limited .Indiranagar Police Station is only troubling affected persons Smt Rani w/o Muniswamyand Muniswamys/o Abbaiah the affected persons and the complainant despite Police taking statements and several hundred pages of documents BDA certified Layout Plan and revenue certified maps and ownership documents showing Muniswamys/o Abbaiah property in S.NO 50 (which is in recovery area as per BDA resolution No 378 Bangalore Development Authority's meeting dated 17-11-1982 and Muniswamys/o Abbaiahis about to get sale deeds as he is in possession of property) and Salarpuria property is in S.No 42TRESS PASSED IN S.NO 50despite status co order given in Crime No.432/2012 under section 448 of IPC Indiranagar Police Station byissuing notices and calls only to affected persons and even once they have not called accused directors of Salarpuria Properties Private Limited to police station . The police has deliberately failed to take action on Mr. R. P. In view of BDA agreed to reconvening the sites in question in favour of Muniswamy s/o Abbaiah The sub-Inespector of police in Indiranagar Police Station have to file charge sheet on the directors of Salarpuria Properties Private Limited noted above as per FIR registered under Crime No.432/2012 under section 448 of IPC . Salarpuria Properties Private Limitedare owners in S No 42 Dukanhalli Villlage Kasba Hobli as per BDA Resolution which was Reconveyed on land to land basis in lieu of S.No 1/1 of Gavipuram Guttahalli as per BDA Resolution. Salarpuria Properties Private Limited who have tress passed in S.No 50 (S No50/1and 50/2 ) of Dukanhalli Villlage Kasba Hobli HAL 2ndStage Bangalore and they should Immediately vacate as it comes in Re-Convey as per BDA resolution in Subject No. 378. As per proceedings of the Bangalore Development Authority's meeting dated 17-11-1982. .¨BDA has agreed to re-convey and execute the sale deeds in favour of Muniswamy s/o Abbaiah who is by affected poor farmer and S.No 50 (S No50/1and 50/2 ) of Dukanhalli (doopanhalli) Villlage Kasba Hobli HAL 2ndStage Bangalor comes in Re-Convey as per BDA resolution in Subject No. 378. As per proceedings of the Bangalore Development Authority's meeting dated 17-11-1982. . Section 38-C BDA Act is prospective in its application except to the extent of the allotment made between 20th December, 1973 to 8th May, 1986 which is saved by Section 9 of the Amendment Act. The resolution of CITB /BDA of 17-11-1982 agreeing to re-convey the part of the land acquired is covered by the provisions of Section 9 of the Amendment Act. In the present case, the resolution of the CITB/BDA is dated 17-11-1982 and it wouldbe deemed to be validated by the deemed fiction created by Section 9 of the Amendment Act to bring it within the provisions of Section 38 -C.
