THE GOVERNOR VAJUBHAI VALA IS NOT SERIOUS ON KSHRC ACTING CHAIRMAN

The several human right activists wanted to meet Governor but his office is not giving them appointment and request for appointment is pending with the governor office since several month. Law and Human right department is sleeping on the burning issues of Human right violations in Karnataka. When Smt Meera Saxena IAS(Retired) herself is accused of injustice how she can deliver justice to victims who are pouring in Human Rights Commission (KSHRC). Sri Vajubhai Vala should take serious note of it and immediately appoint judicial member as acting chairman instead of allowing Smt Meera Saxena IAS(Retired) as acting chairman in view of Karnataka High Court order re-opening Lokayukta case against her and her engaging during her term of office in any paid employment outside the duties of her office as Governor himself has powers under the Human right Protection Act to set the record straight . The state government had recommended the name ofJustice C.G. HUNGUND as acting chairman of KSHRC to Honble Governor H.R.Bhardwaj three times earlier .But Honble Governor H.R.Bhardwaj rejected government proposal three times appointing Justice C.G. HUNGUND as acting chairman of KSHRC without any valid reasons. This is clear insult to entire judiciary. The Karnataka High Court directed the Special Lokayukta Court in Shimoga to consider afresh four private complaints filed including one filed against the Smt Meera Saxena IAS(Retired) .KSHRC Acting chairman is very sensitive post anddignified post and she should resign the post of Acting chairman until she is cleared from the case. Governor Vajubhai Vala should take serious note of it and immediately appoint judicial member as acting chairman in view of Karnataka High Court order. Human rights Activists and groups are demanding that Smt Meera Saxena IAS(Retired)may pleased be dismissed from membership of KSHRC as per section 23(2) (b) of the protection of Human Right Act 1993 for engaging during her term of office in any paid employment outside the duties of her office as she is director in Hindustan Photo Films Manufacturing Company Limited (HPF)  and UPSC PT Board .

Human right activists and groups are fuming on appointment of Smt Meera Saxena IAS(Retired) as acting chairman of KSHRC as she is not eligible to that post as chairman post is reserved for justice and a justice only can be appointed as acting chairman and not ordinary member of KSHRC . Constitution of the KSHRC: Sec. 21 of the Protection of Human Rights Act, 1993, as amended by the Protection of Human Rights (Amendment)Act, 2006 under Chapter V, lays down that the State Government may constitute a Human Rights Commission which shall consist of - 1. A Chairperson who has been a Chief Justice of a High Court and 2.    One Member who is, or has been, a Judge of a High Court or District Judge in the State with a minimum of seven years experience as District Judge; 3.    One Member to be appointed from amongst persons having knowledge of, or practical experience in, matters relating to human rights .The Commission has a Secretary who is the Chief Executive Officer of the State Commission. It is further argued by Human Right Activists that third category of membership is reserved for human right activist to become the member of KSHRC. Appointing an bureaucrat as member of KSHRC is itself questionable. A former bureaucrat cannot handle the complaints' against his fellow bureaucrat effectively Appointing an bureaucrat as member of KSHRCitself questioned by many human right activists as former Bureaucrat and IAS officer is not eligible to become KSHRC Member as third category of membership is reserved only for a person amongst persons having knowledge of, or practical experience in, matters relating to human rights and being IAS officer she was never a human right activist and has zero experience in human right activities.and surly as former IAS officer in-principal she is not eligible to become acting chairman. As KSHRC proactively or reactively inquire into violations of human rights or negligence in the prevention of such violation by a public servant .Why government is afraid of appointing C G Hungund as acting chairman whennobody is willing to come as chairman as per the provision in the Act .

Activists and groups are demanding that Smt Meera Saxena IAS(Retired)may pleased be dismissed from membership of KSHRC as per section 23(2) (b) of the protection of Human Right Act 1993 for engaging during her term of office in any paid employment outside the duties of her office as she is director in Hindustan Photo Films Manufacturing Company Limited (HPF)  and UPSC PT Board . As per the RTI reply given by secretary KSHRC0N 03-06-2013 Smt Meera Saxena IAS(Retired) is director in Hindustan Photo Films Manufacturing Company Limited (HPF)  is a Public Sector Undertaking, under the Department of Heavy Industry, incorporated in the year 1960, with a vision to make India self reliant in the field of Photo sensitized goods and also she is Director in UPSC PT Board .And it is confirmed that she took 10 days leave to attend board meetings and Government had given permission to Smt Meera Saxena IAS(Retired) to attend Board meetings as director. Karnataka Bar council need to intervene in the matter .Government of Karnataka is requested immediately to withdraw the order and appoint Justice C.G. HUNGUND(retired) as acting chairman of KSHRC .Honble Governor H.R.Bhardwaj and CM did injustice to justice Hungundby appointingSmt Meera Saxena IAS(Retired) as acting chairman of KSHRC despite the fact that The state government had recommended the name ofJustice C.G. HUNGUND as acting chairman of KSHRC to Honble Governor H.R.Bhardwaj three times earlier .But Honble Governor H.R.Bhardwaj rejected government proposal three times appointing Justice C.G. HUNGUND as acting chairman of KSHRC . This is clear insult to entire judiciary .After several rounds of consultations, the State government had appointed the former IAS officer Meera Saxena and retired District and Sessions judge Chandrashekar Gurubasappa Hungund as members of the Karnataka State Human Rights Commission in the year November 2012 .The state government had recommended the name ofC.G. HUNGUND as acting chairman of KSHRC to Honble Governor H.R.Bhardwaj .But Honble Governor H.R.Bhardwaj rejected government proposal three times .It was blunder to keep KSHRC headless for one year 6 months..But suddenly CM and Governor appointed Smt Meera Saxena as acting chairman without the knowledge and recommendation from the Law Minister .If at all Honble Governor H.R.Bhardwaj wanted to appoint Smt Meera Saxena acting chairman of KSHRC this could have been done 18 months back .Why Honble Governor H.R.Bhardwaj adopted double standard one for SmtMeera Saxena and another for justice Hungund in appointment of acting chairman .This is clear insult to entire judiciary and Bar."Human Rights” means the rights relating to life, liberty, equality and dignity of the individual guaranteed by the constitution or embodied in the International covenants and enforceable by courts in India. "Commission” means the National Human Rights Commission constituted under section of All human beings are born free and equal in dignity and rights known as Human rights, as commonly understood, are the rights that every human being is entitled to enjoy freely irrespective of his religion, race, caste, sex and nationality, etc. (Jagdish chand, 2007) In Declaration of Independence acknowledged the fundamental human rights. Human right means different thing to different people. Human Rights are not static. New rights are recognized and enforced from time to time. Only persons fully conversant with the latest development about the expanding horizons of Human Rights can promote their awareness better than others.
